Simply put, the Direct EB-5 Investment option is where you can invest in your own business, establish a new business and be in control of your investment. This is a great option if you want to manage your own business and be active in the company/project.
To qualify, you must invest at least $8,000,000 in a project that is located in Target Employment Area (T.E.A) or $1 Million in a project that is located outside of a Targeted Employment Area. The investment in the business must be in the form of cash, equipment, inventory, and other tangible property. Generally, loans do not qualify unless they are secured by assets owned by the investor (not the business), who is personally and primarily liable.
Under the law and the guidelines, the investment must also be in a “new commercial enterprise.” You can establish your own brand-new company or a business that was recently established. Any business formed after November 29, 1990, may qualify.
There is no limit to the number of EB-5 direct investment partners on any given new commercial ventures, as long as each partner that is applying for the EB-5 Green Card invests at least $800,000, and each investment results in the creation of at least 10 new full-time jobs. Therefore, it is allowed if you and other family members, partners, or others want to invest as a group in a new commercial venture.
Of course, your investment must create 10 new full-time jobs for U.S workers (not including you and your family). These jobs must be direct jobs which means hiring for 10 full-time positions. The only exception to this requirement is if the company that you are investing in is considered a “troubled business,” and experiencing a net loss for one or two years of more than 20% of its net worth.
